AXA Malaysia Privacy Notice


AXA-MALAYSIA (referred to hereinafter as the “Company”) recognizes its responsibilities in relation to the collection, holding, processing, use and/or transfer of personal data of its employees under the Personal Data Protection Act 2010. Personal data will be collected only for lawful and relevant purposes and all reasonable steps will be taken to ensure that personal data held by the Company is accurate. The Company will take all reasonable steps to ensure security of the personal data and to avoid unauthorized or accidental access, erasure or other use. PURPOSE

From time to time, it is necessary for you to provide us with your personal data for purposes related to your employment with us, including:

1.    Human resources (“HR”) management purposes, such as: the planning and implementation of staffing and training, promotions, transfers, secondments and other career related matters; the review, implementation and administration of our staff benefits, and payroll administration;

2.    Our provision of references in relation to your employment to your future employers (“employee reference”);

3.    Intra-group communications;

4.    Monitoring compliance with internal rules of the Company, including without limitation any code of business conduct and ethics, and conducting investigations related to compliance with Company policies or applicable laws, reporting any non-compliance to the Company and its agents and service providers;

5.    Carrying out a matching procedure for HR-related purposes or in response to a request for a matching procedure from any government departments or other appropriate governmental or regulatory authorities in Malaysia or overseas and

6.    Other purposes directly relating to any of the above.     

Please note that if you are unable to supply your personal data as requested, the Company may be unable to provide you with employee benefits or take other actions related to your employment (such as providing your next employer with a reference letter) where use of your personal data is required.

 

TRANSFER OF PERSONAL DATA

Personal data will be kept confidential but, subject to the provisions of any applicable law, may be:

1.    Made available to appropriate persons in our affiliated companies, locally and overseas, and in this regard you consent to the transfer of your data outside of Malaysia;

2.    Supplied to any agent, contractor or third party who provides administrative, [information] technology or other services to the Company and/or our affiliates in Malaysia or overseas and who has a duty of confidentiality to us; example of such persons: external auditors, medical practitioners, trustees or administrators or managers of our provident fund scheme, insurance companies, actuaries and any consultants/agents/vendors/service providers appointed by the Company or any of its affiliates to plan, provide and/or administer employee compensation and benefits;

3.    Disclosed to any government departments or other appropriate governmental or regulatory authorities in Malaysia or overseas such as the Inland Revenue Department and the Labour Department (and in this regard you consent to the transfer of your data outside of Malaysia if necessary);

4.    Made available to third parties in the form of Company marketing materials and/or directories identifying names, office telephone numbers, email addresses and other contact information for key officers, senior employees and their secretaries, assistants and support staff for promotional and administrative purposes; and

5.    Made available to any actual or proposed purchaser of all or part of the business of the Company and their legal advisors or, in the case of merger, acquisition or other public offering, the purchaser or subscriber for shares in the company and their legal advisors;

6.    Used, disclosed or transferred for any purpose directly related to your employment with any affiliates of the Company. You are deemed to have given consent for the Company to transfer your data outside of Malaysia. Transfer of your personal data will only be limited to one or more of the purposes specified above.     

Access and correction of personal data Under the Personal Data Protection Act 2010, you have the right of access to your personal data, obtain a copy of the data, and to correct any data that is inaccurate.
Requests for access and correction or for information regarding policies and practices and kinds of data held by the Company should be addressed in writing to the Human Resources Department at:

A reasonable fee may be charged to offset the Company’s administrative and actual costs incurred in complying with your data access requests. Nothing in this statement shall limit the rights of employees and potential employees under the Personal Data Protection Act 2010.
