Krungthai-AXA Life Insurance Public Company Limited (“KTAXA” or “we”) recognizes the importance of protecting the applicant’s ("You”) personal data including sensitive data, so we have prepared this privacy notice to inform you of the collection, use, disclosure, and international transfer of your personal data and sensitive data. Hereinafter, personal data and sensitive data will be mentioned as Personal Information.

• Personal data means any information that can directly or indirectly identify you.

• Sensitive data means any information that is defined by the Personal Data Protection Act ("PDPA") as be sensitive data such as racial, ethnic origin, political opinions, cult, religious or philosophical beliefs, sexual behavior, criminal records, health data, disability, trade union information, genetic data, biometric data, or of any data which may affect the data subject in the same manner

This privacy notice applies to your personal information and other people’s personal information relating with you (“Third Party”) that is necessary for your job application e.g., your family, reference person

4. Data Disclosure and Transfer

For the purposes set out in this Privacy Notice, we may disclose your personal information to companies inside the AXA Group and other third parties outside the group as follows:

4.1 Companies and affiliates within our group for our efficiency and accuracy of business administration or preventing and detecting fraud.

4.2 Recipients and their affiliates for the purposes set out in this Privacy Notice, for example;

(a) Government authorities, supervising authorities or other authorities as stipulated by laws, including competent official, e.g. courts, police officers, etc.

(b) Agencies and/or service providers, such as document storage and destruction service providers, IT development companies, etc.

Disclosure of your personal information to a third party outside of KTAXA will only be made where the third party has agreed to keep your information strictly confidential and shall only be used for the specific purpose for which we provide it to them.

We may also disclose your personal information to other third parties where:

- we are required or permitted to do so by the law or by regulatory bodies; or

- we believe that such disclosure is necessary in order to assist in the prevention or detection of any criminal action including fraud or is otherwise in the overriding public interest; or

- exemptions under the data protection legislation allow us to do so

Some of the recipients set out above may be in countries outside of Thailand notably in Singapore, where KTAXA has a Data Centre, or any other designated AXA group entity as the case may be. Where we make a transfer of your personal information outside of Thailand, in all cases where personal data is transferred to a country which is deemed not to have the same standards of protection for personal data as Thailand will ensure Appropriate Safeguards have been implemented to ensure that your personal information is protected where standards are not the same or similar to those standards within Thailand.

5. Data Retention Period

KTAXA retains your personal information for as long as is considered necessary for the purpose for which it was collected, used or disclosed as set out in this Privacy Notice. If your application is unsuccessful regarding the position you applied for, we will retain your information for 2 years after receiving your application.

6. Your Rights as a Data Subject

According to the Personal Data Protection Act B.E. 2562, you have certain rights relating to your personal information as follows:

1) Right to Access

You have the right to request access to and obtain a copy of your personal information, which is under our responsibility, However, for your personal information safety, we may ask you to verify yourself before complying with your request.

2) Right to Rectification

You have the right to request KTAXA to modify your personal information to be accurate, up-to-date, complete, and not misleading, which is under our responsibility, if you consider that your personal information is inaccurate or changed.

3) Right to Erasure

You have the right to request KTAXA to erase, destroy or make your personal information become unidentifiable data unless we can establish a legitimate ground under data protection law to store your personal information for longer period.

4) Right to Restriction of Processing

You have the right to request KTAXA to restrict the use of your personal information under certain circumstances.

5) Right to Data Portability

Where KTAXA arranges your personal information to be in the format which is readable or commonly used by ways of automatic tools or equipment, and can be used or disclosed by automated means, you have the right to receive your personal information and are also entitled to:

(a) request us to send or transfer your personal information in such formats to other data controllers if it can be done by the automatic means;

(b) request to directly obtain your personal information in such formats that we send or transfer to other data controllers unless it is impossible to do so because of the technical circumstances.

6) Right to Object

You have the right to object to the collection, use, disclosure or transferring of your personal information under certain circumstances such as for direct marketing.

You have the right file a complaint to a competent officer under the Personal Data Protection Act B.E. 2562 (2019) at any time if KTAXA violates or does not comply with such Act.

Please note that in some cases we may not be able to comply with your request for reasons such as our own obligations to comply with other legal or regulatory requirements. However, we will always respond to any request you make and if we cannot comply with your request, we will tell you why.

7.How to Withdraw Consent

You can withdraw consent given to us at any time unless there is a restriction of the withdrawal of consent by law or the contract which gives benefits to you.

However, the withdrawal of consent will not affect the collection, use or disclosure of personal information for which you have previously legally given consent to us.

KTAXA regularly reviews and, if appropriate, updates this Privacy Notice from time to time to ensure that your personal information is properly protected. บริษัท กรุงไทย-แอกซ่า ประกันชีวิต จํากัด (มหาชน) (“บริษัท”) ตระหนักถึงความสำคัญของการคุ้มครองข้อมูลส่วนบุคคลทั่วไปของผู้สมัคร (“ท่าน”) ซึ่งรวมไปถึงข้อมูลส่วนบุคคลที่มีความอ่อนไหวด้วย เราจึงจัดทำนโยบายคุ้มครองข้อมูลส่วนบุคคลฉบับนี้ขึ้นเพื่ออธิบายวิธีการที่บริษัทเก็บรวบรวม ใช้ เปิดเผย และโอนย้ายไปยังต่างประเทศซึ่งข้อมูลส่วนบุคคลทั่วไปและข้อมูลส่วนบุคคลที่มีความอ่อนไหว หลังจากนี้ข้อมูลส่วนบุคคลทั่วไปและข้อมูลส่วนบุคคลที่มีความอ่อนไหวจะเรียกว่า ข้อมูลส่วนบุคคล

• ข้อมูลส่วนบุคคลที่มีความอ่อนไหว หมายถึง ข้อมูลใดๆ ที่พระราชบัญญัติคุ้มครองข้อมูลส่วนบุคคล พ.ศ. 2562 กำหนดให้เป็นข้อมูลส่วนบุคคลที่อ่อนไหว ซึ่งก่อนจะเก็บรวบรวม ใช้ เปิดเผยหรือโอนย้ายจะต้องได้รับความยินยอมจากเจ้าของข้อมูลดังกล่าวก่อน

1. ข้อมูลส่วนบุคคลที่มีการเก็บรวบรวม

รายละเอียดข้อมูลส่วนบุคคล ดังต่อไปนี้

1.3 ข้อมูลส่วนบุคคลทั่วไป

(ก) ข้อมูลติดต่อ (Contact Data) เช่น ชื่อ นามสกุล อีเมล ที่อยู่ เบอร์โทรศัพท์

(ข) ข้อมูลที่ใช้ระบุตัวตน (Identification Information) เช่น วัน เดือน ปีเกิด เพศ อายุ หมายเลขประจำตัวประชาชน หมายเลขหนังสือเดินทาง สถานภาพสมรส รูปถ่าย

(ค) ข้อมูลทางการเงิน (Financial Information) เช่น เงินเดือน

(ง) ข้อมูลเกี่ยวกับการศึกษาและการทำงาน เช่น ประวัติการศึกษา ประวัติการทำงาน ความสามารถ และคุณสมบัติ ประวัติการเข้าหลักสูตรผึกอบรม

(จ) ข้อมูลส่วนตัวอื่น ๆ เช่น ข้อมูลสมาชิกในครอบครัว ข้อมูลบุคคลอ้างอิง และข้อมูลผู้ติตด่อในกรณีฉุกเฉิน

1.4 ข้อมูลส่วนบุคคลที่มีความอ่อนไหว

(ก) ข้อมูลตามสำเนาบัตรประจำตัวประชาชน เช่น ศาสนา หมู่เลือด และข้อมูลเชื้อชาติ

(ข) ข้อมูลเกี่ยวกับสุขภาพ ความพิการ ผลการตรวจสอบสารเสพติด

(ค) ประวัติอาชญากรรม

2. บริษัทเก็บรวบรวมข้อมูลส่วนบุคคลของท่านจากแหล่งใด

บริษัทอาจมีการเก็บรวบรวมข้อมูลของท่านโดยตรงและจากแหล่งอื่น รวมไปถึง

• หน่วยงานราชการ เช่น สำนักงานตำรวจแห่งชาติ สำนักงานตรวจคนเข้าเมือง

• บุคคลอ้างอิงที่ท่านระบุในแบบฟอร์มสมัครงานของบริษัท

• แหล่งข้อมูลสาธารณะอื่นๆ เช่น เว็บไซต์ของบริษัท เว็บไซต์สมัครงานอื่น ข้อมูลที่ค้นหาได้ทางอินเตอร์เน็ต หรือบนแพลตฟอร์มโซเชียลมีเดียต่างๆ

3. วัตถุประสงค์ในการเก็บรวบรวม ใช้ หรือเปิดเผยและโอนย้ายข้อมูลส่วนบุคคล

บริษัทเก็บรวบรวม ใช้ และเปิดเผยข้อมูลส่วนบุคคลของท่านและบุคคลที่เกี่ยวข้อง ตามวัตถุประสงค์ดังต่อไปนี้

3.1 การเก็บรวบรวม ใช้ และเปิดเผยข้อมูลส่วนบุคคลของท่าน

วัตถุประสงค์ในการเก็บรวบรวม ใช้ หรือเปิดเผยข้อมูลส่วนบุคคล	ฐานทางกฎหมายในการเก็บรวบรวม ใช้ หรือเปิดเผยข้อมูลส่วนบุคคล
เพื่อดำเนินการที่จำเป็นในการพิจารณาและคัดเลือกผู้สมัครงาน ในขั้นตอนต่างๆ เช่น ขั้นตอนการสมัครผ่านเว็บไซต์ของบริษัท การสมัครผ่านเว็บไซต์สมัครงานอื่น หรือสมัครผ่านทางบริษัทโดยตรง ขั้นตอนการสัมภาษณ์ ขั้นตอนการประเมินและคัดเลือก และขั้นตอนการเสนอสัญญาจ้างให้แก่ท่าน	ข้อมูลส่วนบุคคลทั่วไป · การดำเนินการตามคำขอก่อนเข้าทำสัญญา ข้อมูลส่วนบุคคลที่มีความอ่อนไหว · ความยินยอมโดยชัดแจ้ง

เพื่อประโยชน์ในการบริหารจัดการภายในองค์กรเกี่ยวกับกระบวนการจ้างงาน เช่น การส่งข้อมูลผู้สมัครหรือรายงานการสัมภาษณ์ให้ฝ่ายที่เกี่ยวข้องและผู้มีอำนาจตัดสินใจคัดเลือก กระบวนการภายในเพื่อจัดทำสัญญาจ้าง รวมถึงกระบวนการบริหารงานบุคคลอื่นๆ	ข้อมูลส่วนบุคคลทั่วไป · การดำเนินการตามคำขอก่อนเข้าทำสัญญา ข้อมูลส่วนบุคคลที่มีความอ่อนไหว · ความยินยอมโดยชัดแจ้ง
เพื่อพัฒนาและทดสอบระบบภายในบริษัท	ข้อมูลส่วนบุคคลทั่วไป · ประโยชน์โดยชอบด้วยกฎหมาย ข้อมูลส่วนบุคคลที่มีความอ่อนไหว · ความยินยอมโดยชัดแจ้ง

3.2 การเก็บรวบรวม ใช้และเปิดเผยข้อมูลส่วนบุคคลของบุคคลที่เกี่ยวข้อง

โปรดแจ้งและขอความยินยอมจากบุคคลที่เกี่ยวข้องก่อนท่านจะเปิดเผยข้อมูลของบุคคลดังกล่าวแก่บริษัท

เพื่อตรวจสอบข้อมูลและประวัติการทำงานของท่านจากบุคคลที่เกี่ยวข้อง เช่น บุคคลอ้างอิง เพื่อประกอบการพิจารณาการรับเข้าทำงานเท่านั้น

4. การเปิดเผยและการโอนย้ายข้อมูลส่วนบุคคล

ในการดำเนินการตามวัตถุประสงค์ที่ระบุไว้ในนโยบายคุ้มครองข้อมูลส่วนบุคคลฉบับนี้ บริษัทอาจเปิดเผยข้อมูลส่วนตัวของท่านให้แก่บริษัทในกลุ่มแอกซ่าและบริษัทในเครือ และบุคคลภายนอก ดังต่อไปนี้

4.1 บริษัทในกลุ่ม และบริษัทในเครือ เพื่อการบริหารธุรกิจอย่างมีประสิทธิภาพและถูกต้อง

4.2 ผู้รับและบริษัทในเครือ เพื่อวัตถุประสงค์ที่ระบุภายใต้นโยบายคุ้มครองข้อมูลส่วนบุคคลฉบับนี้ เช่น

(d) หน่วยงานราชการ หน่วยงานกำกับดูแล หรือหน่วยงานอื่นตามที่กฎหมายกำหนด รวมถึงเจ้าพนักงานซึ่งใช้อำนาจตามกฎหมาย เช่น ศาล ตำรวจ เป็นต้น

(e) ตัวแทน และหรือผู้ให้บริการ ในการดำเนินงานใด ๆ ของบริษัท เช่น ผู้ให้บริการเก็บและทำลายเอกสาร ผู้ให้บริการด้านสารสนเทศ เป็นต้น

(f) บุคคลภายนอกตามความยินยอมจากท่าน หรือตามข้อกำหนดของสัญญา หรือตามข้อกำหนดของกฎหมาย แล้วแต่กรณี

บริษัทจะเปิดเผยข้อมูลส่วนบุคคลของท่านให้แก่บุคคลภายนอกก็ต่อเมื่อบุคคลภายนอกนั้นตกลงที่จะรักษาความลับของข้อมูลอย่างเคร่งครัดและตกลงจะใช้ข้อมูลเพื่อวัตถุประสงค์เฉพาะตามที่บริษัทได้ให้ข้อมูลไปเท่านั้น

บริษัทอาจเปิดเผยข้อมูลส่วนบุคคลของท่านให้แก่บุคคลภายนอกอื่นใดอีก ในกรณีที่

- เป็นการปฎิบัติตามกฎหมาย หรือตามอำนาจของหน่วยงานกำกับดูแล หรือ

- มีเหตุอันควรเชื่อได้ว่าการเปิดเผยนั้นมีความจำเป็นต่อการป้องกันหรือตรวจสอบการกระทำความผิดทางอาญา รวมถึงการฉ้อโกง หรือมีความสำคัญกว่าประโยชน์สาธารณะ หรือ

- มีข้อยกเว้นภายใต้กฎหมายคุ้มครองข้อมูลส่วนบุคคลให้กระทำได้

กรณีที่ผู้รับข้อมูลส่วนบุคคลอยู่นอกประเทศไทย หรือ มีเทคโนโลยีเก็บข้อมูลอยู่นอกประเทศไทย เช่น ประเทศสิงคโปร์ ซึ่งเป็นที่ตั้งของศูนย์เก็บข้อมูลของบริษัท หรือประเทศอื่นใดที่ซึ่งบริษัทในกลุ่มแอ๊กซ่ากำหนดไว้ตั้งอยู่ ตามแต่กรณี กรณีที่มีการโอนข้อมูลส่วนบุคคลของท่านไปยังประเทศปลายทางที่ไม่มีมาตรฐานการคุ้มครองข้อมูลส่วนบุคคลที่เทียบเท่ากับมาตรฐานการคุ้มครองข้อมูลส่วนบุคคลของประเทศไทย บริษัทจะจัดให้มีมาตรการคุ้มครองที่เหมาะสมเพื่อทำให้แน่ใจได้ว่าข้อมูลส่วนบุคคลของท่านจะได้รับความคุ้มครอง

5. ระยะเวลาในการเก็บข้อมูลส่วนบุคคล

บริษัทจะเก็บรักษาข้อมูลส่วนบุคคลของท่านเป็นระยะเวลาเท่าที่จำเป็นเพื่อวัตถุประสงค์ในการเก็บรวบรวม ใช้ หรือเปิดเผยข้อมูลส่วนบุคคลซึ่งได้ระบุไว้ในนโยบายคุ้มครองข้อมูลส่วนบุคคลนี้ หากท่านไม่ประสบความสำเร็จในการประเมินต่างๆ สำหรับตำแหน่งงานที่ท่านได้สมัครไว้ บริษัทจะเก็บข้อมูลของท่านเป็นเวลา 2 ปีนับแต่ได้รับใบสมัครของท่าน

6. สิทธิของท่านในฐานะเจ้าของข้อมูล

ท่านมีสิทธิภายใต้บทบัญญัติของพระราชบัญญัติคุ้มครองข้อมูลส่วนบุคคล พ.ศ. 2562 ดังนี้

1) การเข้าถึงข้อมูลส่วนบุคคล

ท่านมีสิทธิขอเข้าถึงและขอรับสำเนาข้อมูลส่วนบุคคลของท่านซึ่งอยู่ในความรับผิดชอบของบริษัท อย่างไรก็ดี บริษัทอาจให้ท่านยืนยันตัวเป็นตนก่อนดำเนินตามคำขอเพื่อความปลอดภัยของข้อมูลส่วนบุคคลของท่าน

2) การขอแก้ไขข้อมูลส่วนบุคคลให้ถูกต้อง

ท่านมีสิทธิขอให้บริษัทแก้ไขข้อมูลส่วนบุคคลของท่าน ในกรณีที่ท่านเห็นว่าข้อมูลที่บริษัทมีอยู่นั้นไม่ถูกต้องหรือมีการเปลี่ยนแปลงข้อมูลส่วนบุคคลของท่านเอง เพื่อให้ข้อมูลส่วนบุคคลดังกล่าวถูกต้อง เป็นปัจจุบัน สมบูรณ์ และไม่ก่อให้เกิดความเข้าใจผิด

3) การลบข้อมูลส่วนบุคคล

ท่านมีสิทธิขอให้บริษัทลบหรือทำลายหรือทำให้ข้อมูลส่วนบุคคลเป็นข้อมูลที่ไม่สามารถระบุตัวตนได้ด้วยเหตุบางประการได้ เว้นแต่ว่าบริษัทจะมีฐานทางกฎหมายตามพรบ.คุ้มครองข้อมูลส่วนบุคคล เพื่อจัดเก็บข้อมูลส่วนบุคคลของท่านเป็นระยะเวลานานขึ้น

4) การระงับการใช้ข้อมูลส่วนบุคคล

ท่านมีสิทธิขอให้บริษัทระงับการใช้ข้อมูลของท่านด้วยเหตุบางประการได้

5) การให้ส่งหรือโอนข้อมูลส่วนบุคคล

ในกรณีที่บริษัทได้ทำให้ข้อมูลส่วนบุคคลนั้นอยู่ในรูปแบบที่สามารถอ่านหรือใช้งานโดยทั่วไปได้ด้วยเครื่องมือหรืออุปกรณ์ที่ทำงานได้โดยอัตโนมัติและสามารถใช้หรือเปิดเผยข้อมูลส่วนบุคคลได้ด้วยวิธีการอัตโนมัติ ท่านมีสิทธิขอรับข้อมูลส่วนบุคคลของท่านจากบริษัทได้ รวมทั้งมีสิทธิ ดังต่อไปนี้

(c) ขอให้บริษัทส่งหรือโอนข้อมูลส่วนบุคคลในรูปแบบดังกล่าวไปยังผู้ควบคุมข้อมูลส่วนบุคคลอื่นเมื่อสามารถทำได้ด้วยวิธีการอัตโนมัติ

(d) ขอรับข้อมูลส่วนบุคคลที่บริษัทส่ง หรือโอนข้อมูลส่วนบุคคลในรูปแบบดังกล่าวไปยังผู้ควบคุมข้อมูลส่วนบุคคลอื่นโดยตรง เว้นแต่โดยสภาพทางเทคนิคไม่สามารถทำได้

6) การคัดค้านการเก็บรวบรวม ใช้ หรือเปิดเผยข้อมูลส่วนบุคคล

ท่านมีสิทธิในการคัดค้านการเก็บรวบรวม ใช้ เปิดเผยหรือโอนย้ายข้อมูลส่วนบุคคลเพื่อเหตุบางประการ เช่น เพื่อวัตถุประสงค์เกี่ยวกับการตลาดแบบตรงและกรณีอื่นๆ ตามที่กฎหมายกำหนด

ท่านมีสิทธิในการร้องเรียนต่อพนักงานเจ้าหน้าที่ผู้มีอำนาจตามพระราชบัญญัติคุ้มครองข้อมูลส่วนบุคคล พ.ศ. 2562 เมื่อบริษัทฝ่าฝืนหรือไม่ปฏิบัติตามพระราชบัญญัติดังกล่าวได้

อนึ่ง บริษัทอาจมีสิทธิปฏิเสธคำขอใช้สิทธิของท่านเนื่องด้วยเหตุผลบางประการ เช่น เป็นการปฏิบัติหน้าที่ตามกฎหมายของบริษัท อย่างไรก็ตาม บริษัทจะทำการตอบกลับคำขอใช้สิทธิของท่านทุกรณี และหากเป็นกรณีที่บริษัทไม่สามารถปฏิบัติตามคำขอได้ บริษัทจะแจ้งให้ท่านทราบถึงการปฏิเสธและเหตุผลแห่งการปฏิเสธนั้น

7. การเพิกถอนความยินยอม

ท่านมีสิทธิขอเพิกถอนความยินยอมที่ให้ไว้แก่บริษัทในการเก็บรวบรวม ใช้ หรือเปิดเผยข้อมูลของท่านเมื่อใดก็ได้ เว้นแต่การเพิกถอนความยินยอมจะมีข้อจำกัดโดยกฎหมายหรือสัญญาที่ให้ประโยชน์แก่ท่าน

ทั้งนี้ การถอนความยินยอมจะไม่ส่งผลกระทบต่อการประมวลผลข้อมูลส่วนบุคคลที่ท่านได้ให้ความยินยอมแก่บริษัทก่อนหน้าแล้วโดยชอบด้วยกฎหมาย

9. การแก้ไขเปลี่ยนแปลงนโยบายคุ้มครองข้อมูลส่วนบุคคล
